This User Agreement was last updated on 04.05.2020. 

This User Agreement, Eximfix Privacy Policy and the information that can be provided within the site (collectively the Agreement) Your (hereinafter referred to as You, Your or User) with the use of Eximfix site, content and software (hereinafter referred to as "Platform"). By entering the platform on https://www.eximfix.com/, using the site and/or registering on any part of it, you agree to be bound by the legal binding of this User Agreement. 

These Terms are between Al Dar Group Software Ltd. Including its partners and suppliers (collectively Eximfix), and You creates a contract that defines the rights and responsibilities regarding Your (User) use of Eximfix Platform. 

You may only use the platform in accordance with these terms and all applicable local, national and international laws, rules and regulations. 

Eximfix may change this User Agreement from time to time without notice. These changes will be published on the www.eximfix.com address under the "User Agreement" title. 

Your use of the Platform after any changes are posted means that you accept all changes made in this context with the changed User Agreement. For this reason, you should periodically review this User Agreement in case of any change. 

Eximfix can publish notifications within the platform. Eximfix can also send you notifications of new or changed topics to the email address or phone number you provided to us. You are deemed to have received such notices within seven (7) days of the Eximfix's submission. Continuing to use the platform indicates that you have received all notices regardless of delivery method. 

Registration to the Platform or Account Termination 

You can register on the platform either as an individual user (Person) or as a company, organization, government or other legal person user (Organization). 

You must be at least eighteen (18) years old to use the platform. If you are under the age of eighteen (18), you must have the parent, legal guardian or legally authorized representative of the organization to represent you. Anyone who you authorize to register or use the platform on your behalf should be legally authorized. 

If you accept these terms and use the platform on behalf of an organization, you warrant that you are authorized to represent the organization. 

You may need to open and create an Eximfix account with the username and password to use the platform. You may need to provide us with specific information or specific personal information about the organization you represent. Eximfix can verify your e-mail address before using your account or use SMS or e-mail based verification to confirm your Eximfix identity. If the company is registered, Eximfix can also verify the company identity (Company ID, Tax ID and so on) with the help of local authorities. 

Creating an Eximfix account requires data transmission. Data transfer charges may apply and are covered by the User. 

You agree to provide accurate and complete information and keep this information up-to-date when registering on the platform. The right information helps you take full advantage of the platform. Take care to protect your username and password against the abuse of others, and immediately inform Eximfix about any abuse. If you are small, you and your parent or legal guardian are personally responsible for any use of the platform. 

The User cannot allow unauthorized third parties to access Eximfix Services through the User and complies with the security-related instructions published by Eximfix. In order to access Eximfix Services that require paid membership, the User uses the username and passwords provided or approved by Eximfix. The user is responsible for taking the necessary security measures to ensure the security of the username and password provided or approved by Eximfix and cannot show / make that user name and password available to others. 

You acknowledge and understand that it is your responsibility to protect the privacy of your username and passwords that you use to access the platform. 

In this context, you agree that you will be exclusively responsible for Eximfix for all actions performed via your username and password. 

As soon as you realize that your password or account has been used without permission, you agree that you will inform Eximfix without delay. 

You understand and agree that you will use the data you access in Eximfix through your user name and password in accordance with the Eximfix Privacy Policy and Terms of Use. 

Eximfix may provide a mobile application (Application) developed by Eximfix as part of the platform. Your use of the Application may be subject to separate terms and conditions that you must accept before using the Application. If there are no separate terms and conditions applicable to this Application, the following terms apply: Eximfix grants you a limited, non-exclusive, non-transferable right to install and use the Application on your computer and / or mobile device. You do not have the right to use application source code or derivative works, use, change, translate, reproduce, resell, delegate, lease, rent, reverse engineer or otherwise transfer. Open source authorization Terms apply to open source authority software. 

If you no longer want to use the platform, you can terminate your records by contacting Eximfix user support or by sending an email to info@eximfix.com. Eximfix may terminate your registration or restrict access to certain parts of the platform if you have not used the Platform for the past six (6) months or believe it has violated the Eximfix terms. 

Eximfix is ​​not responsible for the deletion or loss of information or content that you submit to the platform other than those specified in the privacy policy. When information or content is removed from the platform by you or Eximfix, tracks or copies may remain elsewhere. 

User Content and Data 

As an agency or its representative, you can send information about you or your Organization, such as photos, logos, other trademark formats, video, audio or text (Data) or other types of digital content to the platform. Eximfix does not claim ownership in your data. Your data submission does not transfer the ownership of the Data rights to Eximfix. Eximfix only transmits Data and is not responsible for editor control regarding this topic. By sending data to the platform, you give Eximfix a worldwide, non-exclusive, allocable, fully paid, royalty-free, permanent and irrevocable authorization to include Data in other studies and allow Eximfix to use the data. 

The user grants Eximfix a non-exclusive right to use all materials included by him in any edition or electronic publication of Eximfix. 

Eximfix does not take any responsibility for the data sent by Users or others, or for information content that can be accessed through direct or indirect hyperlinks available on the Platform. However, Eximfix reserves the right to review, change or delete data that it considers to be illegal, accusatory or inappropriate at its discretion. 

You may not share or distribute any advertising material, including requests for funds or businesses, on the Platform without the prior written consent of Eximfix. 

The user, Eximfix, its affiliates, employees and authorized representatives, including reasonable attorneys fees, (i) the User violates this Agreement; (ii) It agrees to indemnify Eximfix in terms of all damages, liabilities, costs, fees, charges and charges incurred by the User as a result of posting any material on the Platform with the screen name and password of the User. 

The user allows all trade names, trademarks, service marks and other product and service names and logos of his own to be used by Eximfix in the directory services on the Platform for reference and advertisement purposes. 

You are solely responsible for making backup copies of the data you have stored on the platform, including the Content you have uploaded. If the platform is stopped or canceled, Eximfix can permanently delete your data. Eximfix has no obligation to return data to you after the platform is stopped or canceled. 

Paid Services 

Eximfix may restrict the access of Site features or certain areas to be paid Users or users who have special registration processes without prior notice. Access to and use of these Paid Services entitles the Platform to periodically charge for the subscription period. The platform can also suggest a trial period. Users wishing to use the paid portion of the platform are required to pay a non-refundable fee determined by Eximfix from time to time. If your membership includes a trial period, you may be charged when the trial period expires, unless you cancel it in accordance with the subscription / trial terms. 

Fees, payment terms and effective dates for the products and services on the platform will be announced in the relevant sections of the site. You can buy a package depending on your own choice and need. In order to benefit from the Platform, you must pay the fees suggested on the Platform, under the payment conditions declared on the Platform, and by means of the means specified. 

User's credit card information can be requested to offer the option to pay by credit card for Membership Packages. Like other similar communication systems, there is a risk of technical tracking in sending information over the internet. Although Eximfix takes all normal measures to minimize technical tracking, the User is responsible for the risk of the information sent in this way, and Eximfix bears no responsibility for the transfer security of such information. 

The Eximfix or service Partner will forward the invoice for the price of the service received to the contact address transmitted by you. E-archive invoices of users who are not E-invoice users will be created electronically and kept electronically in the invoicing process to be performed by Eximfix. Notification regarding invoices created electronically will be made to the User's e-mail addresses within 7 days at the latest and invoices will be sent via e-mail in PDF format. 

The invoices of the users who procure code from the institutions and organizations whose promotion code is delivered by EXIMFIX are collectively collected and collected to the institution and organization where the promotional code is delivered. The decision of handing over the promotional codes to the User is completely a decision of the relevant institution and organization. Conditions such as services, usage, duration, content to be defined in promotional codes are determined with Eximfix and the relevant institution and organization and these conditions are applied. The user can use the promotional codes that replace Discount or full price at the purchase stage. Apart from these conditions, the User has no right to demand. 

The use of the platform involves the transmission of data over your platform provider's network. The prices listed on the platform do not include possible data transmission, text messaging, voice or other platform provisioning fees by your network provider. 

Eximfix is ​​not responsible for the payment of any fees to your network providers. 

You can pay by credit or debit card, network provider billing, mobile money, or other payment methods, if available. All credit card payments are subject to verification checks and card issuer approval. 

Prices on the platform may change from time to time. Prices include applicable taxes, which are valid during your transaction and unless otherwise stated, and must be paid in full to Eximfix. Depending on local tax laws and regulations, you may have to pay additional taxes. There may be situations where you need to pay an additional fee from your bank or credit card provider, based on the currency conversion rates used and / or the additional fees assessed. Eximfix is ​​not responsible for the payment of the bank or any third party fee or tax. 

The right to add the annual product / demand allocated depending on your package is allocated annually and cannot be transferred to the next year. 

Since the instant services offered by the platform (adding requests, adding products, sending offers, etc.) are among the services covered by the Article 15 (ğ) of the Distance Contracts Regulation (“Services executed instantly in electronic environment… related contracts.”); The user does not have the right to withdraw even if he has the title of consumer. 

Legal person The user is not subject to the legislation regarding consumers. No refund will be made after the payment for any product / service on the platform and the first contact for the service. 

There is no refund or cancellation of Annual Eximfix Membership Service Sales. 

Platform Availability and Technical Requirements 

The availability of the content and platform may vary and may vary at Eximfix's sole discretion. Eximfix explicitly disclaims any representations or warranties that a particular Content or platform will be used. The platform may not be available in all countries and is only available in selected languages. Platform, operations and some features may also depend on the network, compatibility of devices used, and supported content formats. 

To access the platform, you may need to download a specific piece of application developed by Eximfix or another party. 

Eximfix, at its sole discretion, can completely, partially replace, fix or stop the platform. Access to the platform may not be possible during maintenance times and at other times. To make sure you have the latest Eximfix software and apps, your device can automatically check if app updates are available from Eximfix. If there is any detection, you will be asked to confirm the installation. You can disable automatic checking of updates with the settings on your device. You can also download the application update via the available software update channels. If Eximfix thinks an Application update is important or critical, you cannot continue using the previous version of the application. Eximfix may prevent you from using the previous version of the application or platform until you install the update. 

Eximfix may disable any Content, platform or application on your platform account for any reason and remove any content or application and / or disable copies of any application on your device to protect the platform, application providers, wireless carriers on your network. Eximfix can significantly change any platform or application version or decide not to release a final version. 

Links to Third-Party Sites and Content 

You can access websites operated by other than Eximfix through hypertext or other computer links. These hyperlinks are provided for your reference and convenience only and are the exclusive responsibility of the respective website owner. 

Eximfix has no control over third-party content, sites or platforms, and is not responsible for the platforms or materials created or published on these third-party sites or platforms. A link to a third-party site does not imply that Eximfix approves the site or the referenced products or platforms on the site. 

In addition, Eximfix is ​​not responsible for such content or links if you and other users create other content and links that are not available on the platform. You must review and accept the terms of these sites or platforms before using these sites or Platforms. 

As part of the platform, Eximfix may provide access to the content (External Content) developed by Eximfix and provided by Eximfix (Eximfix content) and third parties or organizations provided within the platform. Using the platform or third-party platforms such as YouTube. Content that includes both Eximfix content and external content is called (Content). Some Eximfix content may have geographic restrictions. 

Limitation of Liability 

PRODUCTS, SERVICES AND ACTIVITIES IN THE PLATFORM ARE PROVIDED "AS IT IS" AND WITHOUT WARRANTY OF ANY KIND. ALSO, EXIMFIX, DOES NOT GUARANTEE ANY PRODUCTS OR SERVICES DISPLAYED AND OFFERED ON THE EXIMFIX PLATFORM.  EXIMFIX, DOES NOT GUARANTEE ACCURACY OF RESULTS TO BE TAKEN FROM THE PLATFORM, SUCH AS: COMPLETENESS OR TIMELINESS AND CONFORMITY FOR THE CONDITION, QUALITY, DURABILITY, PERFORMANCE, PRECISILITY, RELIABILITY OR COMMERCIAL STATUS OF OTHER MATERIALS CAN BE REACHED ON EXIMFIX VIA DIRECT OR INDIRECT THROUGH HYPERLINKS. 

EXIMFIX MAKES NO WARRANTY OR REPRESENTATION ABOUT THE VALIDITY, ACCURACY, RELIABILITY, QUALITY, STABILITY, COMPLICITY AND CURRENCY OF ANY INFORMATION DISPLAYED ON THE PLATFORM. EXIMFIX DOES NOT TAKE ANY RESPONSIBILITY FOR THE PRODUCTS, SHIPPING, DISTRIBUTION, OFFERING, SHOWING, PURCHASING, DISTRIBUTION, OFFERING, SHOWING, PURCHASING, SALE OR USE OF THE SERVICES AND PRODUCTS DISPLAYED ON THE PLATFORM.

Ownership and Intellectual Property Rights 

You acknowledge and agree that Eximfix owns all legal rights, legal property and earnings on the Platform, including all intellectual property rights existing under the Platform (regardless of whether these rights are registered and where they exist in the world). 

Eximfix grants a non-exclusive, non-transferable, non-transferable authority at any time, at Eximfix's sole discretion, to access and use the Platform in full terms. The use of the platform does not give you any intellectual property rights in any information or content on the platform. 

Unless you have made a written agreement with Eximfix, no provision in these Terms of Use gives you the right to use Eximfix's trade name, trademark, service mark, logo, domain name and other identifying brand features. 

The User acknowledges that he / she does not acquire any right on the Platform or on the data it compiles using the Platform. The user cannot change or remove any copyright symbol or other identifying brand features or information of Eximfix. 

The User may not modify, alter or adapt any part of the Platform, and use any software or technique to access Eximfix Services without permission, or use any software that may damage the Eximfix Services. It is strictly forbidden for the user to use any hacking method or technique while using / using Eximfix Services. 

All rights of all articles, graphics and pictures in the platform content belong to Eximfix. Also, copying or using the software used in the design and database creation of this Platform is strictly prohibited. 

The platform, its content and applications are protected by international copyright laws. Eximfix requests the copyrights in its platform, content and application to the maximum extent required by law. Subject to the above conditions, Eximfix retains all the rights and interests of the platform content, application and software. 

Eximfix and Ads 

The platform may contain advertising. Ads can be targeted to content or information stored on the platform, queries made via the platform, or other information. 

Eximfix and Your Privacy 

The Privacy Policy and any additional privacy information made available to you govern the use of data about you as an individual user or as a representative of an organization. 

Making changes to the conditions 

Eximfix may change the conditions at any time without notice. If the terms are changed in a material, negative manner, Eximfix will issue a separate notice regarding the change. 

You are responsible for regularly reviewing the terms. Your continued use of the platform creates your consent for any changes and modifications. 

Legal Notice and Applicable Law 

The terms do not exclude or limit any of your compulsory rights that cannot be waived by law in your country. If a provision of terms is found to be invalid, the remaining terms will not be affected, and the invalid provision will be replaced by a valid one that is closest to the outcome and purpose of the terms. If one or more provisions of these terms are not related to your use of the platform, it will not affect the validity or applicability of the other terms or conditions as a whole. In the event of any conflict between the Eximfix platform terms and the privacy policy, the terms of these Eximfix terms apply. The terms of the conditions foreseen to continue with the termination of your registration continue to be valid after the termination. 

Terms, regardless of conflicts of law provisions are subject to the laws of the Republic of Turkey. 

In disputes that may arise from the use of the information on platforms and content, Turkish Disclaimer, Terms of Use and Privacy Policy text is to prevail, Istanbul - Turkey courts and execution offices are authorized. Transactions in Istanbul - will be carried out from Turkey. Also, an agreement is not made through third parties. 

If any court of law, having the jurisdiction to decide on this matter, determines that any of the terms in the Terms of Use are invalid, this provision will be removed from the Terms of Use without affecting any other terms in the Terms of Use. The remaining provisions of the Terms of Use will continue to be in force and enforceable. 

The platform content cannot be used by any person or organization that is the competitor of Eximfix or that performs similar activities with Eximfix and provides products and services to third parties in any way. 

All third party claims, such as violating the Terms, (ii) violating any intellectual or third party property, other rights or privacy rights, or (iii) misuse of the platform by third parties if you cannot take reasonable steps to protect your username and password from abuse. and you agree to defend Eximfix against any liability, loss, cost or damage arising from them and to compensate for all financial liability resulting from them 

Feedback 

By submitting any ideas, feedback and / or offer (Feedback) to Eximfix via the platform or other means, you agree to: (1) Eximfix may have similar development ideas with feedback; (2) your views do not contain confidential or proprietary information of you or third parties; (3) Eximfix is ​​not under any confidentiality obligation with regard to feedback; (4) Eximfix can freely use, distribute, exploit and further develop and modify opinions for any purpose; and (5) You are not entitled to any compensation from Eximfix. 

Copyright Infringement Claim 

You can report copyright infringements on the platform to Eximfix by writing a Copyright Notification on the subject line, by email, or by using the online form to info@Eximfix.com. Your report should include: 

1. Identify the original copyrighted work that you claim has been infringed, 

2. Identify the content on the platform that you claim is infringing copyrighted works. Please provide enough detail so that Eximfix can find content that is allegedly infringing on the platform, 

3. Provide your contact information, including your name, phone number and e-mail address, 

4. Declaring that you have a good belief that the use of the content as complained is not the copyright owner, its agent, or authorized by law, 

5. Provide this statement: I swear that the information contained in this notification and complaint is correct and that I am right to copyright or have been authorized to act on behalf of an exclusive copyright owner. 

6. Sign as appropriate. 

Transfer of Rights and Obligations 

Eximfix may transfer its rights and obligations under these conditions to its parent ocompany, its subsidiaries or any company under joint control with Eximfix. In addition, Eximfix may assign its rights and obligations under these terms to a third party in relation to merger, purchase, sale of assets, operation of the law or otherwise.
